Personally Identifiable Information

We collect personally identifiable information when You provide it to us through Your use of the Site and through completing an Agreement with TGUC Financial (“Agreement(s)”), and when a third-party lead generator (“Lead Generator”) provides Your information to us after obtaining Your authorization to submit Your information to TGUC Financial for home-improvement financing. A contractor or other home-service business that You select or authorize through a Lead Generator is referred to in this Privacy Policy as a “Home Service Provider.” Additionally, the Site may collect personally identifiable information when You register with us through our Site, when You complete a form or survey connected to our Site, and through Your usage of our Site. We may also receive Your name, residential or project address, telephone number, email address, information about Your requested home-improvement project, and evidence of Your consent from Lead Generators and Home Service Providers. The types of personally identifiable information we collect may include, but are not limited to: (a) full name; (b) physical mailing address; (c) daytime, evening, residential and mobile telephone number; (d) Social Security Number; (e) email address; (f) date of birth; (g) driver’s license number and state; (h) gender; (i) marital status; (j) occupation; (k) employment information; (l) salary information; (m) credit card information and ID verification information; (n) citizenship status, and (o) loan application, prequalification status, and prequalification amount.

Non-Personally Identifiable Information
non-personally identifiable information is anonymous information that cannot be associated with a specific individual. The types of non-personally identifiable information that we collect (either directly, through the use of “cookies,” or through the use of a third party tracking system) may include, but is not limited to: (a) the IP address of the computer making the request; (b) Your browser type and language; (c) access times; (d) information about areas of the Site visited by Users of the Site; (e) information about the links that Users may select to visit on the Site; (f) the type of browser You are using (i.e. Internet Explorer, Firefox); and (g) the type of operating system You have (i.e. Mac OS). How We Use Personally Identifiable Information

We use information collected through this Site or received from Lead Generators and Home Service Providers to deliver and manage the products or services You have requested; evaluate and prequalify You for financing with participating lenders; connect You with a Home Service Provider or Network Contractor; facilitate estimates, project planning, financing, and funded home-improvement transactions; provide You with customer support; to send Your confirmations and/or to provide You with information; to communicate with You by email, postal mail, telephone, and/or mobile devices about products or services that may be of interest to You either from us, our marketing partners, or other third parties; to display advertising tailored to Your interests or background; perform data and statistical analysis on use of the web site; to enforce our Privacy Policy and Terms of Use, and to perform any other functions otherwise described to You at the time we collect the information.

We may record and supplement the information we collect online with outside records to enhance our ability to serve You, to tailor our content to You and to offer You opportunities to purchase services or products we have reason to believe may be of interest to You.

Disclosing Your Information

We may disclose Your information to lenders and lending partners to evaluate Your eligibility for home-improvement financing and to process, administer, or service requested financing. If You selected or authorized a Home Service Provider through a Lead Generator, we may disclose Your prequalification status and prequalification amount to that Home Service Provider to facilitate the home-improvement project and related financing You requested. If You have not selected a Home Service Provider, we may offer to connect You with a contractor participating in TGUC Financials’ contractor network (“Network Contractor”). Before making that disclosure, TGUC Financial will request Your authorization to disclose Your name, residential or project address, telephone number, email address, and, if applicable, prequalification status and prequalification amount to the identified Network Contractor. Network Contractors are independent businesses. They may use the information to contact You about home services, estimates, project scheduling, project fulfillment, and related financing. TGUC Financial may receive a referral fee when a consumer referred to a Network Contractor completes a funded transaction. TGUC Financial will disclose a consumer’s contact information and, if applicable, prequalification amount to a Network Contractor only after identifying the Network Contractor to the consumer and obtaining the consumer’s affirmative direction to make the disclosure. TGUC Financial will not disclose the information to an unidentified Network Contractor or to a Network Contractor that was not covered by the consumer’s authorization. TGUC Financial will maintain records of the authorization presented to and provided by the consumer. TGUC Financial does not disclose Your Social Security number, financial account credentials, consumer report, credit score, bureau attributes, tradelines, or underlying consumer-report information to a Home Service Provider or Network Contractor. Any third parties with whom we share personally identifiable information may have their own policies which describe how they use and disclose Your information. Those policies will govern the use, handling, and disclosure of Your information once we have transferred or shared it with those third parties as described in this Policy or our Terms of Use.

TGUC Financial may receive a referral fee when a consumer referred to a Network Contractor completes a funded transaction. As a result, TGUC Financials’ disclosure of personal information to a Network Contractor may constitute a “sale” of personal information under applicable state privacy laws. Where required, You may opt out of such disclosures as described in the California Privacy Policy and Notice below. Subject to Your authorization, applicable law, and any applicable opt-out request, we may disclose the information we collect about You: (a) with lenders and lending partners to evaluate, process, administer, or service requested financing ; (b) to a Home Service Provider or Network Contractor as described above; (c) to third-party vendors to carry out services performed for TGUC Financial; (d) in the event TGUC Financial is sold to another entity, as an asset, Your personal information may be disclosed; (e) in response to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement agency or other government agency; (f) to establish or exercise our legal rights; (g) to defend against legal claims; (h) as necessary to investigate, prevent, or take action regarding illegal activity, suspected fraud or other wrongdoing; (i) to protect and defend the rights, property, or safety of our company, our employees, our Site Users, or others; (j) to enforce our Site terms and conditions or other agreements or policies; and (k) as otherwise required by law.

Disclosing Your Information With Consumer Reporting Agencies

Consumer Reporting Agencies (CRAs) collect and maintain information on consumer and business credit profiles on behalf of organizations in the United States. We may share information about you with CRAs and may carry out periodic searches with them to verify your identity or manage your account.

Details of your account(s) with us may be sent to CRAs and recorded by them. This information may be supplied by CRAs and may be used and searched by us and other organizations, such as lenders, service providers, and debt collection agencies, for permissible purposes including:

consider applications for credit and credit related services;
manage and collect on your accounts;
verify identity and prevent fraud; and
locate debtors and recover debts;

The right to obtain an annual copy of your credit file from CRAs by visiting https://www.annualcreditreport.com.
The right to dispute inaccurate or incomplete information with the CRA and us;
The right to be informed if information in your credit report has been used against you, such as in denying credit or other adverse actions, along with information on how to obtain a copy of your credit report used in the decision; and
The right to restrict sharing of your information with nonaffiliated third parties in certain circumstances.

Modification of Personal Information; Opting Out

To ensure that You have appropriate control over your personally identifiable information, if You would like to review and/or request changes to the personally identifiable information that we have collected about You through Your use of this Site, please contact us in writing or by sending an email to the address below. At Your request and as permitted by law, we will remove Your name and other personally identifiable information from our active databases. Please understand, however, that it may be impossible to remove this information completely, due to backups and records of deletions. Opt-Out of Communications

By submitting your information on this Site, you consent to receive marketing and other communications from this Site, our affiliate(s) and/or a lender or lending partner within our network only to the extent described in the consent presented when You submit Your information. A Home Service Provider or Network Contractor may contact You when You have selected that business or have separately authorized TGUC Financial to connect You with the identified business. Any consent to receive marketing calls or text messages will identify the businesses covered by the consent and describe the permitted communications. You may opt out of marketing-related communications by following the opt-out or unsubscribe instructions contained in the marketing communications sent to you or emailing us at [email protected] or the relevant sender of the communication. You may continue receiving administrative and services-related messages even if you opt out of receiving marketing communications.

SMS opt-in records and SMS consent information are not sold or disclosed to third parties for their independent marketing purposes. This restriction does not prohibit TGUC Financial from disclosing Your telephone number to a Home Service Provider or an identified Network Contractor when You have requested or authorized the referral and related contact. Consent to receive marketing calls or text messages is not a condition of obtaining financing or purchasing goods or services. You may opt out of TGUC Financial text messages by replying STOP. You should direct an opt-out request concerning another sender to that sender.

Consent

By using the Site, you consent to our collection and use of your information, in accordance with this Privacy Policy. If you do not agree with some, or all of the terms of this Privacy Policy, you may not visit TGUC Financials’ Site.

We collect this information directly from consumers and from Lead Generators, Home Service Providers, lenders, consumer reporting agencies, and service providers. We use this information for the financing, referral, communication, fraud-prevention, security, legal, and operational purposes described in this Privacy Policy. We may disclose the information to lenders, Home Service Providers, Network Contractors, service providers, government authorities, and other recipients described in this Privacy Policy.

Sale of Personal Information

TGUC Financial may disclose identifiers and financial or commercial information, including a consumer’s contact information and prequalification amount, to an identified Network Contractor. Because TGUC Financial may receive a referral fee when the consumer’s transaction is funded, this disclosure may constitute a sale under the CCPA. California residents may opt out by contacting TGUC Financial at [email protected]. TGUC Financial will process opt-out requests and will not resume the applicable sale unless permitted by law. A consumer may separately direct TGUC Financial to disclose personal information to an identified Network Contractor to respond to the consumer’s request for home services. TGUC Financial will maintain records of the authorization presented to and provided by the consumer.
